The Sovereignty Question Every Firm Should Be Asking

Building a Legal AI Strategy That Holds Up

Most conversations about legal AI still center on capability: which tool summarises contracts better, which model handles due diligence faster. Those are valid questions, and for practitioners building independent practices, often in specialist areas where AI can genuinely compress the gap between a lean team and a large one, they matter enormously. But for law firms and in-house teams operating under EU law, there is a more foundational question that deserves equal attention:

Who controls the infrastructure your AI runs on and what legal framework governs it?

This is not a theoretical concern. The EU AI Act (Regulation 2024/1689) is now in force, applying in phases, with full obligations taking effect in 2026 for higher-risk use cases, a category that, depending on deployment context, can include tools used for legal work, such as document review and contract analysis. At the same time, GDPR continues to apply to every query, every output, and every piece of client data processed by these systems. The interaction between these two frameworks is not always straightforward, and most vendors have not made it easy to assess.

What "sovereignty" actually means in practice

The term gets used loosely. For legal professionals, it needs to be precise. True data sovereignty requires more than EU data residency. It requires that the legal entity operating the infrastructure is itself subject to European law, and that access by non-EU authorities can only occur through established mutual legal assistance channels. Where an AI provider's parent company is headquartered in a jurisdiction with extraterritorial data access laws (such as the US CLOUD Act), EU-hosted data may still be exposed to conflicting legal obligations that sit entirely outside the practitioner’s control.

For law firms and legal departments, this matters for three specific reasons:

  1. Client confidentiality obligations: privileged data flowing through infrastructure subject to conflicting jurisdictional claims creates a risk profile that most engagement letters were not written to accommodate;
  2. Regulatory auditability: Articles 10 and 12 of the EU AI Act require complete, immutable logs of AI system activity; if your vendor cannot demonstrate this at the infrastructure level, you carry the liability for using a non-compliant tool. 
  3. Duty of supervision: using AI tools without clear policies, training, and oversight mechanisms for both lawyers and support staff is increasingly a professional conduct issue, not just an IT one.

Independent legal practitioners, especially those serving clients in highly regulated sectors, face a distinctive dynamic here. Their clients often arrive with developed expectations around cybersecurity, data handling, and vendor governance. They will ask questions. They may have their own information security requirements that flow down into engagement terms.

A practitioner who has thought through their AI infrastructure, who can explain where data is processed, under what legal framework, and what their contingency looks like if a vendor relationship changes, is in a fundamentally different position than one who cannot. This is not purely a compliance story. It is a client confidence story.

It is also worth being clear-eyed about risk proportionality here. For most independent practices, the more immediate sovereignty concern is not just a data access scenario. It is also availability. What happens if a vendor changes its terms, restructures its EU operations, or becomes inaccessible due to a commercial or regulatory decision made in another jurisdiction? That is a concrete operational risk, but it is one that can be designed around.

The architectural decision that matters most right now

The firms and legal departments making the most defensible choices are not necessarily choosing the "best" model. They are building with auditability and portability as design principles from day one, using abstraction layers that allow them to swap models or providers as the regulatory and competitive landscape shifts, rather than being locked into a single ecosystem whose compliance posture they cannot fully audit or control.

The EU's digital sovereignty agenda, spanning the AI Act, GDPR, the Data Governance Act, and the Data Act, is not a patchwork of isolated rules. Together, these instruments form a coherent regulatory architecture designed to govern AI from the infrastructure layer up. A practice’s AI strategy needs to be designed with that architecture in mind, not retrofitted to it after deployment. For practitioners building independent practices from scratch, getting it right at the outset is considerably easier that correcting it later. Do so and it becomes a genuine differentiator when clients in regulated sectors start asking the right questions. 

Three practical questions worth addressing now:

  1. Can your current AI provider demonstrate full inference and data processing within EU-sovereign infrastructure, not simply EU data centers, but under a legal entity governed by European law and free from conflicting jurisdictional obligations?
  2. Do you have a documented risk classification for each AI use case in your practice, as required under the EU AI Act's tiered obligations?
  3. If your primary AI provider changed its terms, pricing, or compliance posture tomorrow, how quickly could your team migrate?

The firms that will be well-positioned in three years are those treating AI governance as a strategic discipline and not a one-time procurement decision. For those building independent practices today, that foundation is worth laying early, and it is one of the areas where working with people who have done it before makes a material difference.
